These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you", or "your") and GoodMyFood ("we", "us", or "our"). By downloading, installing, accessing, or using the GoodMyFood mobile application ("the App"), you agree to be bound by these Terms in their entirety. If you do not agree, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using GoodMyFood from the Apple App Store, Google Play Store, or any other authorised distribution channel, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
  • You are at least 13 years of age (or the applicable minimum age in your jurisdiction) and legally capable of entering into a binding agreement.
  • If you are using the App on behalf of an organisation, you have the authority to bind that organisation to these Terms.
  • You accept these Terms voluntarily and without reservation.
  • Your continued use of the App after any updates to these Terms constitutes your acceptance of the revised Terms.

2. Nature of the App

GoodMyFood is a nutrition coaching and tracking assistant application that:

  • Helps you track food intake, calories, macronutrients (protein, carbs, fat, fibre), and micronutrients (14 vitamins, 14 minerals).
  • Provides A.I-powered food suggestions personalised to your health conditions, allergies, and dietary preferences using an on-device A.I model.
  • Generates offline health reports including weekly summaries, monthly reports, and body-system betterment reports.
  • Optionally provides Cloud A.I features (food photo scanning and voice description logging) that require an internet connection.
  • Tracks additional wellness metrics including mood, hydration, exercise, and menstrual cycle.

What GoodMyFood Is NOT:

  • GoodMyFood is NOT a medical device, medical app, or health monitoring device.
  • GoodMyFood is NOT a replacement for professional medical advice, diagnosis, or treatment.
  • GoodMyFood is NOT a clinical tool and should not be used for clinical decision-making.
  • GoodMyFood does NOT diagnose, treat, cure, or prevent any disease or medical condition.
  • GoodMyFood does NOT guarantee any specific health outcomes or results.

3. Payment, Pricing, and Refund Policy

3.1 Available Plans

GoodMyFood is available through the Apple App Store and Google Play Store under two pricing models:

Lifetime Plan (One-Time Payment)

A single, one-time payment that grants you a perpetual, non-transferable, non-exclusive licence to use the App on your personal device(s) associated with your app store account. This includes access to all features available at the time of purchase and future updates that enhance existing features, at no additional cost (subject to our discretion).

Monthly Subscription

A recurring monthly payment that grants you access to all App features for the duration of your active subscription. Your subscription will automatically renew each month unless cancelled before the renewal date. Cancellation can be done at any time through your Apple App Store or Google Play Store account settings. Upon cancellation, you will retain access until the end of your current billing period.

  • Both plans include access to all features available at the time of purchase or subscription.
  • We may offer new premium features or add-ons separately in the future, which would be clearly marked and priced.
  • The purchase or subscription is tied to your Apple ID or Google account and can be restored on your devices as per app store policies.
  • Subscription management (renewal, cancellation) is handled through the respective app store, not through the App directly.

3.2 Refund Policy

Due to the digital nature of this product and because the App delivers its full value immediately upon download:

  • For the Lifetime Plan: All sales are final. We do not offer refunds, returns, or exchanges for lifetime purchases.
  • For the Monthly Subscription: You may cancel at any time through your app store account settings. No partial refunds are provided for the remaining days of a billing period after cancellation.
  • We strongly encourage you to review the App's feature descriptions, screenshots, and this documentation thoroughly before purchasing.
  • Refund requests for purchases made through the Apple App Store or Google Play Store are subject to the respective platform's refund policies and are handled by those platforms, not by us.
  • Dissatisfaction with the App's features, design, accuracy of nutritional data, or A.I suggestions does not constitute grounds for a refund from us.
  • Technical issues should be reported to our support team. We will make reasonable efforts to resolve technical problems, but resolution is not guaranteed and does not entitle you to a refund.

By completing your purchase, you acknowledge that you have reviewed the App's features and descriptions, you understand the no-refund policy, and you agree that all sales are final. No warranties, guarantees of satisfaction, or money-back offers are provided.

4. Medical Disclaimer and Health Advisory

THIS IS NOT MEDICAL ADVICE

GoodMyFood is a nutrition coaching and tracking assistant. It is designed to help you understand and track your food intake, nutritional information, and general wellness metrics. This App does NOT provide medical guidance, medical diagnosis, treatment plans, or clinical recommendations of any kind.

The information, suggestions, reports, and insights provided by GoodMyFood -- whether generated by the on-device A.I, the Cloud A.I, or the curated nutritional database -- are for general informational and educational purposes only. They are based on generalised nutritional science and publicly available dietary guidelines, and are not tailored to your specific medical situation.

You expressly acknowledge and agree that:

  • The App's food suggestions (including "What to Eat", "What to Avoid", and "Make It Healthy" features) are general recommendations based on nutritional science, not personalised medical prescriptions.
  • The A.I-generated insights, betterment reports (Skin Health, Heart Health, Bone Health, Immunity, Energy Levels, etc.), and body-system analyses are informational estimates, not clinical assessments.
  • Nutritional data accuracy (whether 95% from on-device A.I or 80%+ from Cloud A.I) is an approximation and may vary. You should not rely solely on these figures for medical or clinical decisions.
  • You will ALWAYS consult a legally certified medical practitioner, registered dietitian, or qualified healthcare professional before making significant dietary changes, especially if you have medical conditions.
  • You will not disregard, delay, or discontinue professional medical advice or treatment based on information from this App.
  • The App's support for 100+ health ailments and allergies is for personalising food suggestions, NOT for diagnosing or treating those conditions.
  • The cycle/period tracker and mood tracker are wellness tools, not medical diagnostic instruments.

5. A.I Features Disclaimer

GoodMyFood uses artificial intelligence in two forms: an on-device A.I model and an optional Cloud A.I service. You acknowledge the following regarding A.I-generated content:

  • A.I-generated food suggestions, nutritional analyses, and health insights are probabilistic estimates and may contain errors.
  • The on-device A.I provides approximately 95% accuracy for manual food searches. This means approximately 1 in 20 results may be inaccurate.
  • The Cloud A.I (photo scanning and voice logging) provides approximately 80%+ accuracy. This means approximately 1 in 5 results may be inaccurate.
  • A.I models are trained on generalised data and may not account for every individual food variation, regional preparation method, or local ingredient difference.
  • You should review A.I-generated results for reasonableness and correct any obvious errors before relying on them.
  • We continuously work to improve A.I accuracy, but we do not guarantee any specific level of accuracy or performance.
  • A.I features (especially Cloud A.I) may experience downtime, latency, or reduced performance due to server maintenance or network conditions.

6. User Responsibilities

By using GoodMyFood, you agree and accept that:

  • You will use the App responsibly and only for its intended purpose as a nutrition tracking and coaching assistant.
  • You understand that this is an informational and educational tool, not a medical device or healthcare service.
  • You will consult qualified healthcare professionals for any medical advice, diagnosis, or treatment.
  • You are solely responsible for all dietary decisions you make, whether or not they are informed by information from the App.
  • You will not rely exclusively on the App for managing any medical condition, allergy, or health concern.
  • You are responsible for the accuracy of information you enter into the App (personal profile, health conditions, food entries).
  • You will keep your account credentials secure and not share your account with others.
  • You will not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or its A.I models.
  • You will not use the App in any way that violates applicable laws or regulations.
  • You assume all responsibility for how you use the App and the information it provides.

7. Limitation of Liability

7.1 No Warranties

GoodMyFood is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We expressly disclaim any and all warranties regarding:

  • The accuracy, completeness, reliability, or timeliness of any nutritional data, A.I suggestions, or health insights.
  • The results or outcomes you may experience from using the App.
  • The App meeting your specific requirements, expectations, or health goals.
  • Uninterrupted, timely, secure, or error-free operation of the App.
  • The accuracy of food photo recognition or voice description processing.
  • The suitability of any food suggestions for your specific medical conditions or health needs.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, GoodMyFood, its developers, officers, employees, affiliates, agents, contractors, licensors, and suppliers shall not be liable for any:

  • Direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind.
  • Loss of data, revenue, profits, goodwill, or other intangible losses.
  • Personal injury, adverse health effects, or health complications of any nature.
  • Damages arising from reliance on any information, suggestions, or reports provided by the App.
  • Damages arising from misuse of the App or failure to follow professional medical advice.
  • Damages resulting from any interruption, suspension, or discontinuation of the App or any of its features.
  • Damages arising from unauthorised access to or alteration of your data on your device.
  • Damages arising from the actions or omissions of third-party services (app stores, advertising partners, cloud providers).

7.3 Maximum Liability Cap

In jurisdictions that do not allow the complete exclusion of liability, our total aggregate liability to you for all claims arising out of or relating to the use of the App shall be limited to the amount you paid for the App. This limitation applies regardless of the form of action, whether in contract, tort (including negligence), warranty, or otherwise.

8. Misuse of the App

We are not responsible or liable for any consequences arising from the misuse of the App. Misuse includes, but is not limited to:

  • Using the App as a substitute for professional medical advice, diagnosis, or treatment.
  • Making significant dietary changes based solely on App information without consulting a healthcare professional.
  • Relying on A.I suggestions for managing serious health conditions, severe allergies, or life-threatening dietary restrictions without professional verification.
  • Ignoring professional medical advice in favour of information from the App.
  • Using the App for any purpose other than personal nutrition tracking and education.
  • Attempting to exploit, hack, or reverse-engineer the App or its A.I models.
  • Sharing or distributing the App or its content in violation of intellectual property rights.
  • Using the App on behalf of others for clinical or medical advisory purposes.

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

  • Food logs, health data, medical data, and profile data are stored exclusively on your device and are never uploaded to our servers.
  • If you uninstall the App or lose your device, locally stored data cannot be recovered by us. You are solely responsible for backing up your device.
  • Optional Cloud A.I features (photo scanning, voice logging) temporarily process data on our servers but do not permanently store it.
  • We collect limited account information (email, display name) for authentication purposes only.

10. Intellectual Property

All intellectual property rights in the App, including but not limited to:

  • The App's source code, algorithms, and A.I models (both on-device and cloud).
  • The curated nutritional database compiled with insights from 20+ clinical nutrition experts.
  • All text, graphics, user interface designs, logos, icons, images, and visual elements.
  • The "GoodMyFood" name, brand, and associated trademarks.
  • The unique features including "Make It Healthy" suggestions, "What to Eat / What to Avoid" engine, betterment reports, and all A.I-driven personalisation features.
  • All content, documentation, and marketing materials.

are the exclusive property of GoodMyFood and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your purchase grants you a licence to use the App; it does not transfer any ownership of intellectual property to you.

11. Account Termination

We reserve the right to suspend or terminate your account and access to the App if:

  • You violate any provision of these Terms.
  • You engage in fraudulent, abusive, or illegal activity.
  • You attempt to reverse-engineer, hack, or compromise the App's security or A.I models.
  • We are required to do so by law or legal process.
  • We discontinue the App or any of its services (with reasonable notice where possible).

Upon termination, your licence to use the App is revoked. Data stored on your device remains on your device; however, account-related data on our servers will be deleted per our Privacy Policy. Termination does not entitle you to a refund.

12. Indemnification

You agree to indemnify, defend, and hold harmless GoodMyFood, its developers, officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Any claim that your use of the App caused damage to a third party.
  • Any dietary or health decisions you make based on information from the App.
  • Your failure to consult appropriate medical professionals when necessary.

13. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the App shall be resolved as follows:

  • Informal Resolution: Before filing any formal proceeding, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.
  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where GoodMyFood is incorporated, without regard to conflict of law principles.
  • Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of the jurisdiction where GoodMyFood is incorporated.
  • Class Action Waiver: To the extent permitted by law, you agree to resolve disputes on an individual basis and waive the right to participate in class actions, class arbitrations, or representative proceedings.
  • Time Limitation: Any claim or cause of action arising out of these Terms or the App must be filed within one (1) year after the cause of action arose, or it shall be permanently barred.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent, or if modification is not possible, it shall be severed from these Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoodMyFood regarding the use of the App. These Terms supersede all prior or contemporaneous agreements, communications, representations, and understandings, whether oral or written, between you and GoodMyFood regarding the App. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

16. Changes to These Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion.

  • Material changes will be communicated through the App or via the email address associated with your account.
  • The "Last updated" date at the top of these Terms will be revised to reflect the date of the most recent changes.
  • Your continued use of the App after any modifications constitutes your acceptance of the updated Terms.
  • If you disagree with the updated Terms, your sole remedy is to stop using the App.
  • We recommend reviewing these Terms periodically to stay informed of any changes.
